01Agreement to these terms
These Terms of Service ("Terms") are a contract between you and Baby App PRO ("we", "us", "our"). They govern your access to and use of the Baby App PRO iOS application and any related services (together, the "Service").
By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
If you are using the Service on behalf of another person (for example, a co-parent's household), you confirm that you have the authority to bind that person to these Terms.
02Who can use the Service
You must be at least 18 years old to create an account and use the Service. The Service is designed for parents and caregivers to track information about infants. We do not knowingly allow people under 18 to create accounts.
The Service is intended to be used on an iPhone running iOS 18 or later. You are responsible for the compatibility of your device and for any data or mobile charges associated with your use.
03Your account
You can create an account with Sign in with Apple or continue anonymously on your device. You are responsible for safeguarding your account credentials and for any activity that takes place under your account.
You agree to provide accurate information when prompted (for example, your baby's name or date of birth if you choose to enter them) and to keep your contact details current so we can reach you about the Service.
If you believe your account has been accessed without your permission, contact us at hello@babyapp.pro as soon as possible.
04Subscriptions, free trials, and billing
Some features of the Service (including sleep predictions and family sharing) are part of "Premium". Premium is offered as an auto-renewing monthly subscription, an auto-renewing yearly subscription, and a one-time lifetime purchase.
Billing. All purchases are processed by Apple through your App Store account under Apple's Media Services Terms. Pricing for your region is shown on the App Store listing and in-app before you confirm a purchase.
Free trial. If we offer a free trial (for example, 2 weeks on the yearly plan), you will not be charged until the trial ends. If you do not cancel before the end of the trial, your subscription will renew automatically at the price displayed when you subscribed.
Auto-renewal. Subscriptions renew automatically for the same duration at the then-current price unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription at any time in the App Store under your Apple Account → Subscriptions.
Refunds. Because Apple handles billing, refund requests are made directly to Apple via reportaproblem.apple.com. Apple's policies apply. We do not process refunds ourselves.
Lifetime. A lifetime purchase unlocks Premium for as long as the Service remains available. It does not obligate us to keep any specific feature running forever; we may retire features as described in section 9.
05Your licence to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Service on devices you own or control, solely for your personal, non-commercial use and in accordance with these Terms and Apple's Standard EULA.
You may not copy, modify, reverse-engineer, decompile, or create derivative works from the Service, except as permitted by applicable law. You may not sell, sublicense, rent, or lease the Service.
06Your data
You retain ownership of the data you enter about your baby and your household ("Your Data"). You grant us a limited licence to store, process, transmit, and display Your Data solely to provide the Service to you and the caregivers you invite.
You can export Your Data at any time from within the app as a structured JSON file. You can also delete your account and all of Your Data; deletion is completed within 72 hours.

07Acceptable use
When using the Service, you agree not to:
- use the Service for any unlawful purpose or in violation of these Terms or applicable law;
- upload data about anyone other than a child in your care or your household;
- attempt to disrupt, overload, or compromise the security of the Service or any related system;
- attempt to circumvent subscription or licensing controls;
- scrape, crawl, or systematically extract data from the Service;
- misrepresent your identity or impersonate someone else.
We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms.
08Not medical advice
Sleep predictions, notifications, and other outputs of the Service are based on patterns in the data you enter. They are meant to help you plan, not to replace the judgement of a qualified healthcare professional. If you have any concern about your baby's health, sleep, feeding, or development, consult a paediatrician.
In an emergency, call your local emergency number. Do not rely on the Service to detect or respond to emergencies.
09Availability and changes to the Service
We work hard to keep the Service available, but we do not guarantee uninterrupted operation. We may temporarily suspend the Service for maintenance, security, or reasons beyond our reasonable control.
We may add, change, or remove features over time. If we retire a feature that was a material reason you purchased a subscription or lifetime unlock, we will give you reasonable notice and, where required by law, a prorated refund.
10Intellectual property
The Service, including its design, code, copy, logo, and other content we provide, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any of those rights to you, except for the limited licence in section 5.
11Disclaimers
To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service will meet your specific requirements.
Nothing in these Terms limits any warranty or consumer right that cannot be excluded under the law of your country of residence.
12Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability for any claim relating to the Service is limited to the amount you paid us (through Apple) in the twelve months before the event giving rise to the claim, or, if you have not made a payment, to fifty euros (€50).
Some jurisdictions do not allow certain liability limitations. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
13Termination
You may stop using the Service at any time. You can delete your account from the app's settings, which will erase Your Data on our servers within 72 hours.
We may suspend or terminate your access to the Service if you materially breach these Terms, if your continued use creates a legal or security risk, or if we are required to do so by law. Where reasonable, we will notify you before we act.
Sections that by their nature should survive termination (for example, data ownership, disclaimers, limitation of liability, governing law) will survive.
14Governing law and disputes
These Terms are governed by the laws of Romania, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Service will be submitted to the competent courts of Romania.
If you are a consumer resident in the European Union, you also benefit from any mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
15Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will notify you in the app or by email (if you have provided one) at least 14 days before the change takes effect, unless the change is required by law or is in your favour, in which case it may take effect sooner.
If you do not agree to the updated Terms, your only recourse is to stop using the Service and cancel any active subscription.
